Cambodia: Government is intimidating civil society

With regard to the draft Law on Associations and Non-Governmental Organizations (LANGO), Mr. Uwe Kekeritz, Member of the German Parliament and Spokesperson for Development Cooperation expressed his concerns as follows:

The draft LANGO presented by the government fails to meet the minimum international human rights standards. According to the content of the draft, the government aims to silence local and international civil society organizations that have been actively supporting Cambodian people in their struggle against land grabbing and human rights violations.

In addition to the three highly controversial judiciary laws which were adopted in 2014 and which now guarantee the government’s influence on the judicial system the NGO law is just another step on the way to an autocratic state. With the additionally announced laws on the limitation of trade union activities and internet freedom the government does its utmost to censure dissenting views and to weaken civil society.

Germany’s bilateral development cooperation must be evaluated bearing the human rights situation in mind. Cambodia’s already precarious human rights situation will be aggravated by the NGO law. The Cambodian government tries to suppress any criticism or public debate in this regard. The guidelines of Germany´s Ministry of Economic Cooperation and Development state that gave human rights violations are the ground for cut or suspension of public development aid. Therefore, the Germen government should communicate this fundamental guideline to the Cambodian government and must, if necessary, act accordingly.

Background: In future NGOs in Cambodia must remain „politically neutral“, and will not be allowed to jeopardize “security, culture and tradition” of Cambodia. There will be an obligation for NGOs to register with the government and any activity without registration will be prohibited. Members of a de-registered NGO are not allowed to establish a new NGO. Foreigners will not be allowed to establish NGOs either. Foreign NGOs who will be denied registration will not have the possibility to appeal.

Kambodscha: Regierung will Zivilgesellschaft einschüchtern

Zum neu vorgelegten NGO-Gesetz in Kambodscha erklärt Uwe Kekeritz, Sprecher für Entwicklungspolitik:

Der von der kambodschanischen Regierung vorgelegte Entwurf eines NGO-Gesetzes widerspricht in wesentlichen Teilen internationalen menschenrechtlichen Standards. Die Regierung will mit dem Gesetzesentwurf kritische nationale und internationale NGOs mundtot machen, die die Bevölkerung in ihrem Kampf gegen Landraub und Menschenrechtsverletzungen unterstützen.

Nach der umstrittenen Justizreform von 2014, mit der sich die Regierung den Einfluss auf die kambodschanische Justiz gesichert hat, ist das NGO-Gesetz der nächste Schritt auf dem Weg zu einem autokratischen Staat. Mit den zusätzlich angekündigten Gesetzen zur Beschränkung von Gewerkschaftsaktivitäten und Internetfreiheit setzt die Regierung alles daran, Kritik zu unterbinden und die Zivilgesellschaft zu schwächen.

Die entwicklungspolitische Zusammenarbeit Deutschlands mit Kambodscha muss im Lichte der Menschenrechtslage bewertet werden. Die Menschenrechtssituation in Kambodscha ist bereits prekär und wird durch den Gesetzesentwurf weiter verschärft. Die kambodschanische Regierung will jegliche Kritik und auch jede Öffentlichkeit diesbezüglich zukünftig verhindern. Gemäß den BMZ-Richtlinien kann es bei gravierenden Verstößen gegen die Menschenrechte zur Verminderung oder Aussetzung der staatlichen Entwicklungszusammenarbeit kommen. Dies muss die Bundesregierung nun gegenüber der kambodschanischen Regierung deutlich machen und nötigenfalls auch konsequent umsetzen.

Hintergrund:

Zukünftig müssen NGOs in Kambodscha „politisch neutral“ sein und dürfen nicht gegen „Sicherheit, Kultur und Tradition“ Kambodschas verstoßen. Es besteht ein Registrierungszwang; jegliche Aktivität ohne Registrierung ist verboten. Mitglieder einer einmal verbotenen NGO dürfen keine neue Organisation gründen. Auch Ausländerinnen und Ausländern in Kambodscha wird verboten einen Verein zu gründen. Ausländische NGOs, denen eine Registrierung in Kambodscha verwehrt wird, haben keine Berufungsmöglichkeit.
